Terms of Service

Welcome to PetPodium. By accessing or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

1. Acceptance of Terms

By creating an account or using PetPodium, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to these Terms and our Privacy Policy.

2. Description of Service

PetPodium is a mobile application where users can:

Upload photos of their pets
Vote on other users' pet photos
Compete for weekly cash prizes

3. Account Registration

To use certain features, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use
Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

By uploading photos to PetPodium, you:

Represent that you own the pet in the photo or have permission to submit it
Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the app and for promotional purposes
Agree not to upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Understand that your username and photos will be visible to other users

We reserve the right to remove any content that violates these Terms.

5. Prohibited Conduct

You agree NOT to:

Create multiple accounts to manipulate voting or contests
Use bots, scripts, or automated methods to vote or interact with the app
Upload photos that do not feature your own pet
Upload inappropriate, offensive, or illegal content
Harass, threaten, or abuse other users
Attempt to circumvent security measures
Interfere with the proper functioning of the app

6. Contest Rules

Weekly contests are governed by our separate Contest Rules. By participating, you agree to those rules in addition to these Terms.

7. Prizes and Payments

Winners are determined based on vote counts at the end of each weekly contest period. Winners must:

Verify pet ownership by submitting a verification photo
Provide valid payment information (PayPal, Venmo, or other supported methods)
Respond to verification requests within 7 days

We reserve the right to disqualify entries that violate our rules or appear fraudulent.

8. Intellectual Property

The PetPodium app, including its design, features, and content (excluding user-generated content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

9. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your violation of these Terms or your use of the app.

12. Termination

We may suspend or terminate your access to the app at any time, for any reason, without notice. Upon termination, your right to use the app ceases immediately.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the app shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if eligible.
